In accordance with its necessary business practices Evans Research Associates, Inc., collects and processes personal data relating to its customers. Evans Research Associates, Inc., is committed to being transparent about how it collects and uses that data, and to meeting its data protection obligations as defined by the GDPR.

 

What information do we collect?

When you visit, use, or navigate our services, we may process personal information depending on how you interact with us and our services, the choices you make, and the features you use.

  • Personal Identification Information: We collect personal information that you provide to us. This may include the following: name, address, contact details, email, phone. We may also collect other demographic information including age, gender, race or ethnic origin, date of birth, company or school name, title, occupation, job function, and company details, such as the size or industry of the organization where you work. This information is collected when you submit it while completing a market research survey for us on behalf of one of our clients. We do not collect special categories of personal data.

 

Data will be stored in a range of different places, including in IT systems (including email), and marketing and sales-related software/spreadsheets. We have organization and technical processes and procedures in place to protect your personal information; however, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect your information.

Why does Evans Research Associates, Inc. process personal data?

We process your information to provide, improve, and administer our survey results in aggregate with other survey respondents. We process your information only when we have a valid reason to do so. We only process your personal information when we believe it is necessary and we have a valid legal reason to do so.

What legal basis do we rely on to process your information?

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal basis we rely on to process your personal information. This includes:

  • Consent. We may process your information if you have volunteered to provide it by taking a survey or otherwise given us permission (consent) to use your personal information for a specific purpose. You can withdraw your consent at any time.

 

We may process your information if you have given us specific permission or in situations where your permission can be inferred (i.e., implied consent).

 

Who has access to data?

Your information may be shared internally or with our clients for legitimate business reasons, such as providing market research survey results, marketing, or other client relationship building activities. This includes members of the marketing and sales teams, company analysts, and IT.

 

Evans Research Associates, Inc. may disclose your information to third parties if we determine that such disclosure is necessary to fulfill the contract/provide requested services to our customers or to comply with the law. For how long does Evans Research Associates, Inc. keep data?

Evans Research Associates, Inc. will retain your information for as long as it is necessary to provide our services and/or complete data analytics processes unless otherwise required by law.

  • Request the organization to change incorrect or incomplete data

  • Request the organization to delete (right of erasure) or stop processing your data, for example where the data is no longer necessary for the purposes of processing.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information and securely store it.

For example, we store the personal information you provide on computer systems with limited access that are located in controlled facilities. In addition, everything submitted to us is encrypted with a method that is used widely on the Internet to keep information secure.

 

Secured-core PCs protect encryption keys, user credentials, and other sensitive data behind a hardware barrier. This prevents bad actors and malware from accessing or altering user data

 

Although we use advanced encryption, we cannot guarantee the security of the information you transmit to us. While our website is secure, the Internet is not.

The privacy notice satisfied with notice requirements defined in both Privacy Acts. If you believe we are unlawfully processing your personal information, you have the right to submit a complaint to the Office of the Australian Information Commissioner or the Office of New Zealand Privacy Commissioner.

Legal Process Guidelines

Government & Law Enforcement within the United States

These guidelines are provided for use by government and law enforcement agencies within the United States when seeking information from Evans Research Associates, Inc. about respondent data. Evans Research Associates, Inc. will update these Guidelines as necessary.

These Guidelines do not apply to requests made by government and law enforcement agencies outside the United States.

For government and law enforcement information requests, Evans Research Associates, Inc. complies with the laws pertaining our data, and we provide details as legally required. For all requests from government and law enforcement agencies within the United States for content, with the exception of emergency circumstances (defined in the Electronic Communications Privacy Act 1986, as amended), Evans Research Associates, Inc. will only provide content in response to a search warrant issued upon a showing of probable cause, or customer consent.

All requests from government and law enforcement agencies outside of the United States for content, with the exception of emergency circumstances (defined below in Emergency Requests), must comply with applicable laws, including the United States Electronic Communications Privacy Act (ECPA). A request under a Mutual Legal Assistance Treaty or the Clarifying Lawful Overseas Use of Data Act (“CLOUD Act”) is in compliance with ECPA. Evans Research Associates, Inc. will provide respondent data only in response to such legally valid process.

For private party requests, Evans Research Associates, Inc. complies with the laws pertaining to customer data and provides data as legally required.
